These Terms of Service (“Terms”) govern your access to and use of PMStackerz (the “Service”), including our website, web app, and any related products and services.

By creating an account, accessing the Service, or purchasing a product, you agree to these Terms.

1) Who we are

“PMStackerz,” “we,” “us,” and “our” refers to the operators of the PMStackerz Service.

2) Eligibility and accounts

You must be at least 18 years old to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and keep it updated.

3) The Service (important)

PMStackerz is an organizational and tracking tool. We do not provide financial, investment, tax, or legal advice, and nothing in the Service should be interpreted as such.

Spot prices, valuations, and totals are estimates and may be delayed, incomplete, or inaccurate. You are responsible for verifying values before making decisions.

4) Acceptable use

You agree not to:

Access or use the Service in a way that violates any law or regulation.
Attempt to bypass security controls or probe/scan the Service.
Upload malware, scrape the Service excessively, or interfere with normal operation.
Use the Service to infringe intellectual property or privacy rights.

We may suspend or terminate access if we believe you violated these Terms or used the Service in a harmful way.

5) Your content and data

You retain rights to the information you enter into PMStackerz (“User Content”). You grant us permission to host, process, and display your User Content solely to provide and improve the Service.

6) Purchases, subscriptions, and trials

We may offer one-time purchases (physical or digital products) and subscription plans.

Trials: If a free trial is offered, trial terms (length and discount eligibility) may change over time. A trial does not guarantee ongoing availability.
Subscriptions: You can cancel at any time, and your subscription will remain active through the end of the current billing period unless otherwise stated in the checkout flow.
Payments: Payments are processed by third parties (for example, Stripe). We do not store full payment card numbers on our servers.

7) Shipping and returns

If you purchase physical products, shipping times and costs are described on our Shipping page. Return and refund rules are described on our Refund Policy page. Those policies are part of these Terms.

8) Intellectual property

The Service, including branding, design, text, graphics, and software, is owned by PMStackerz or its licensors and is protected by intellectual property laws.

9) Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PMSTACKERZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11) Indemnification

You agree to indemnify and hold harmless PMStackerz from claims arising out of your misuse of the Service or violation of these Terms.

12) Changes to the Service or Terms

We may update the Service and these Terms from time to time. If we make material changes, we will update the “Last updated” date and may provide additional notice.
